Nirbhaya case: Govt wants no delay in hanging, HC reserves order

New Delhi, The Central government on Sunday told the Delhi High Court that the indefinite stay imposed on the execution of the four convicts in the Nirbhaya gang-rape and murder case was a “deliberate, well-calculated and well-thought out attempt to frustrate the process of law” and that there should be “no delay” in their hanging. The bench of Justice Suresh Kumar Kait, holding during a special court proceeding on the weekend, later reserved its order on the Centre’s plea. Appearing for the Centre, Solicitor General Tushar Mehta said: “In the interest of the society and victim, there should be no delay. Even in the case of the convicts, the Supreme Court says that there should be no delay as it would have dehumanising effect on the convict.” He also presented a chart before the court explaining the legal remedies availed by the four death row convicts till now. The court was hearing a petition filed by the Ministry of Home Affairs (MHA) challenging the stay imposed by the sessions court on the hanging of Vinay, Akshay, Mukesh and Pawan — convicted for raping a medical student in December 2012. “There is a deliberate, well-calculated and well-thought design to frustrate the process of law. Mukesh took an ingenious plea which the trial court mistakenly accepted. Mercy jurisdiction is individual,” Mehta said...

Nirbhaya convict files mercy plea a day before hanging

He was the only convict who had not availed of the remedy of mercy petition. Another convict, Akshay Singh, had last week filed another mercy plea, asserting that the previous one was “incomplete”. The four convicts — Akshay Singh, Pawan Gupta, Vinay Kumar Sharma and Mukesh Kumar — are scheduled to be hanged at 6 a.m. on March 3. The case pertains to the gang-rape and murder of a 23-year-old girl, called later as Nirbhaya, in the national capital in December 2012. Six people, including the four convicts and a juvenile, were named as accused. Ram Singh, the sixth accused, allegedly committed suicide in Tihar jail days after the trial began in the case. The juvenile was released in 2015 after spending three years in a correctional home...

Delhi Court refuses stay on hanging of Nirbhaya convicts

New Delhi, A Delhi court on Monday dismissed an application seeking stay on execution of death-row convicts in Nirbhaya rape and murder case. The four convicts –Akshay Singh, Pawan Gupta, Vinay Kumar Sharma and Mukesh Kumar — are scheduled to be hanged at 6 a.m. on March 3. After the pronouncement of order, counsel for convicts, A.P. Singh apprised Additional Sessions Judge Dharmendra Rana that Pawan has filed a mercy petition on Monday. The court will consider the fresh mercy petition at 2 p.m. on Monday. The convict filed the plea after his curative petition was rejected by the Supreme Court earlier on Monday. Pawan was the only convict who had not yet exhausted his legal remedies. Nirbhaya’s mother expressed happiness over dismissal of convict’s application and said, “I am glad that they will be hanged tomorrow. These last few hours are crucial for us.” During the course of proceedings, Public Prosecutor Irfan Ahmad, told the court that condemned convict are playing with the rule of law and are adopting all kinds of frivolous tactics to delay the hanging...

WhatsAppFacebookTwitterTelegramEmail New Delhi, A Delhi court on Saturday issued notice to the Tihar Central Jail authorities on a petition that sought a stay on the execution of four death-row convicts in the Nirbhaya rape and murder case. The four convicts moved the application to seek a stay on their hanging scheduled for March 3 on the ground that a fresh mercy and curative petition filed by two of them is pending. “This hon’ble court (should) stay the execution of the petitioners until determination of their mercy petition…,” the petition read. The matter is listed for hearing at 10 a.m. on March 2. The court asked the jail authorities to submit a report on their petition. During the hearing on Saturday, advocate AP Singh told the court that Akshay Kumar Singh had filed a fresh mercy petition as the facts in the previous one were not complete. Another convict Pawan Gupta has filed a curative petition in the Supreme Court. Out of all the convicts, he has not yet availed the remedy of filing a mercy plea. The mercy petitions of three convicts — Mukesh Kumar Singh, Vinay Kumar Sharma and Akshay Kumar Singh — have already been rejected by President Ram Nath Kovind...
