Nirbhaya convict’s wife moves court for divorce

New Delhi, In yet another ploy to delay hanging, wife of a Nirbhaya convict has filed for a divorce in a local court in Bihar’s Aurangabad. In the plea, the wife of convict Akshay Kumar Singh has said she does not want to live the life of a widow as her husband is set to be hanged on March 20. The court has posted the matter for March 19. Punita, Akshaya’s wife, has said, “My husband is innocent. I want to be legally divorced before he is hanged.” Punita’s lawyer Mukesh Kumar Singh, speaking to media in Aurangabad said, “My client (Akshay Kumar Singh’s wife Punita Singh) has a right to seek divorce from her husband. That is why I have filed a plea in the family court. She has the right to seek divorce under Section 13(2)(II) of Hindu Marriage Act which says a woman can seek divorce if the husband has, since the solemnisation of the marriage, been guilty of rape, sodomy or bestiality.” A senior lawyer at Tis Hazari court in Delhi told IANS, “Yes, the woman can file for divorce if her husband has been convicted in a case of rape.” All the four convicts of Nirbhaya — Mukesh Singh (32), Pawan Gupta (25), Vinay Sharma (26) and Akshay Kumar Singh (31) are currently lodged in Tihar jail and are set to be hanged on March 20. New Delhi, The Central government on Sunday told the Delhi High Court that the indefinite stay imposed on the execution of the four convicts in the Nirbhaya gang-rape and murder case was a “deliberate, well-calculated and well-thought out attempt to frustrate the process of law” and that there should be “no delay” in their hanging. The bench of Justice Suresh Kumar Kait, holding during a special court proceeding on the weekend, later reserved its order on the Centre’s plea. Appearing for the Centre, Solicitor General Tushar Mehta said: “In the interest of the society and victim, there should be no delay. Even in the case of the convicts, the Supreme Court says that there should be no delay as it would have dehumanising effect on the convict.” He also presented a chart before the court explaining the legal remedies availed by the four death row convicts till now. The court was hearing a petition filed by the Ministry of Home Affairs (MHA) challenging the stay imposed by the sessions court on the hanging of Vinay, Akshay, Mukesh and Pawan — convicted for raping a medical student in December 2012. “There is a deliberate, well-calculated and well-thought design to frustrate the process of law. Mukesh took an ingenious plea which the trial court mistakenly accepted. Mercy jurisdiction is individual,” Mehta said...

The four convicts — Akshay Singh, Pawan Gupta, Vinay Kumar Sharma and Mukesh Kumar — are scheduled to be hanged at 6 a.m. on March 3. New Delhi, A Delhi court on Monday dismissed an application seeking stay on execution of death-row convicts in Nirbhaya rape and murder case. The four convicts –Akshay Singh, Pawan Gupta, Vinay Kumar Sharma and Mukesh Kumar — are scheduled to be hanged at 6 a.m. on March 3. After the pronouncement of order, counsel for convicts, A.P. Singh apprised Additional Sessions Judge Dharmendra Rana that Pawan has filed a mercy petition on Monday. The court will consider the fresh mercy petition at 2 p.m. on Monday. The convict filed the plea after his curative petition was rejected by the Supreme Court earlier on Monday. Pawan was the only convict who had not yet exhausted his legal remedies. Nirbhaya’s mother expressed happiness over dismissal of convict’s application and said, “I am glad that they will be hanged tomorrow. New Delhi, Not happy with yet another adjournment given by the court, Nirbhaya’s mother on Wednesday broke down inside the courtroom and pleaded the judge to issue fresh date for the execution of four convicts. “I have been requesting the court for one and a half year to ask the convicts to avail their legal remedies. It has been more than seven years. What about my rights?” Asha Devi pleaded to the court. The reaction came after the Patiala House Court Additional Sessions Judge Dharmendra Rana adjourned the hearing, on application seeking issuance of fresh execution date after advocate A.P. Singh apprised the court that he is no longer representing convict Pawan Gupta in the case, for Thursday. The court gave Pawan the “liberty to choose” his counsel from the list of empanelled advocates of the Delhi State Legal Service Authority. The matter will now be heard on at 3 p.m. on February 13.
