J&K govt remits stamp duty on documents for fresh loans

WhatsAppFacebookTwitterTelegramEmail Srinagar, In a major relief to traders, the Jammu and Kashmir government on Friday ordered remitting of stamp duty on documents for fresh/additional loan for borrowers whose accounts have been restructured due to the unprecedented situation in the Valley since August 5 last year following the abrogation of Article 370. The J&K finance department has issued a notification to remit stamp duty on fresh loans for borrowers whose accounts have been restructured. “In exercise of the powers conferred by Clause (a) of Section 9 of the Stamps Act, the government hereby directs that there shall be remission of duty chargeable under the said Act in case of instruments/documents executed between the borrowers and the tending financial institutions on fresh/additional loans advanced by such institutions to the borrowers whose accounts have been restructured upon authorisation by Reserve Bank of India (RBI) in terms of RBI’s master directions dated October 17, 2018, (on relief measures by banks in areas affected by natural calamities) due to unprecedented situation in Kashmir Valley since August 5, 2019,” read the notification issued by Financial Commissioner Arun Mehta. The notification said that branch heads of the lending financial institutions shall certify that the loan accounts of the borrowers who are being extended the fresh/additional loans have been restructured in terms of RBI’s master directions of October 17, 2018 due to the unprecedented situation in the Valley. The notification has come into force with immediate effect and will be valid up to one year from the date of issuance...

SC reserves order on plea challenging J&K curbs

New Delhi, The Supreme Court on Wednesday reserved judgement on a clutch of pleas, including the one by senior Congress leader Ghulam Nabi Azad, challenging the restrictions imposed on the erstwhile state of Jammu and Kashmir after revocation of Article 370. “We are more concerned about the future,” said the court. After hearing the detailed arguments of petitioners and the Centre, justifying the restrictions, a bench of Justice N.V. Ramana, Justice R. Subhash Reddy and Justice B.R. Gavai reserved the verdict. Solicitor General Tushar Mehta consistently maintained that during the imposition of restrictions in the Jammu and Kashmir region, neither a single life was lost nor a single bullet fired. Senior advocate Kapil Sibal, representing Azad, said restrictions have virtually abrogated the fundamental rights and paralyzed the lives of seven million people in the region...

SC decision on Chidambaram’s bail plea in ED case on Wed

New Delhi, The Supreme Court is scheduled to pronounce on Wednesday its judgement on senior Congress leader P. Chidambaram’s bail plea in the INX Media money laundering case registered by the Enforcement Directorate. On November 28, a bench headed by Justice R. Banumathi had reserved judgement on the appeal filed by Chidambaram challenging the November 15 verdict of the Delhi High Court denying him bail. The apex court had allowed the ED to submit three sets of sealed covers in the two volumes. “The Registry is directed to receive the sealed cover and keep them in safe custody for perusal of the court, if required,” the court said. Solicitor General Tushar Mehta, representing the ED, told the court that Chidambaram is extremely influential even from custody, while senior advocates Kapil Sibal and A.M. Singhvi, appearing for the former Union Minister, told the bench that the ED cannot orally prejudice the court against the grant of bail. Sibal told the court that alleged emails, bank transactions indicating at money laundering have been said to be connected to Chidambaram, but where is the evidence to link all these with him? “Show one piece of evidence… you cannot destroy reputations,” he contended. Attacking the ED case against Chidambaram, the senior lawyer said that the ED should show one property, one bank account and one telephone call, which establishes Chidambaram is involved in the case, insisting that “the entire case is nothing beyond allegations”...

A bench headed by Justice N.V. Ramana is currently hearing two petitions filed by Anuradha Bhasin, editor of a newspaper, and Ghulam Nabi Azad, senior Congress leader, on the restrictions on freedom of movement, press, etc. Solicitor General Tushar Mehta, appearing for the Jammu and Kashmir administration, contended the fundamental rights under Article 19 are not absolute and can be regulated in the interest of sovereignty, integrity, security of the state and the general public. “First and foremost fundamental duty is to secure the safety and protection of the citizens in Jammu and Kashmir… after examining the facts on ground, it is essential to discharge the constitutional obligation to the people of the region,” he said...

Nirbhaya case: Govt wants no delay in hanging, HC reserves order

New Delhi, The Central government on Sunday told the Delhi High Court that the indefinite stay imposed on the execution of the four convicts in the Nirbhaya gang-rape and murder case was a “deliberate, well-calculated and well-thought out attempt to frustrate the process of law” and that there should be “no delay” in their hanging. The bench of Justice Suresh Kumar Kait, holding during a special court proceeding on the weekend, later reserved its order on the Centre’s plea. Appearing for the Centre, Solicitor General Tushar Mehta said: “In the interest of the society and victim, there should be no delay. Even in the case of the convicts, the Supreme Court says that there should be no delay as it would have dehumanising effect on the convict.” He also presented a chart before the court explaining the legal remedies availed by the four death row convicts till now. The court was hearing a petition filed by the Ministry of Home Affairs (MHA) challenging the stay imposed by the sessions court on the hanging of Vinay, Akshay, Mukesh and Pawan — convicted for raping a medical student in December 2012. “There is a deliberate, well-calculated and well-thought design to frustrate the process of law. Mukesh took an ingenious plea which the trial court mistakenly accepted. Mercy jurisdiction is individual,” Mehta said...
